In a significant ruling, a divided federal appeals court in the United States has overturned a lower court decision that had temporarily prevented a government downsizing team, spearheaded by Elon Musk, from accessing sensitive data held by several federal agencies. The decision marks a victory for the Trump-era initiative aimed at streamlining government operations.

The 4th U.S. Circuit Court of Appeals, in a closely contested 2-1 judgement, lifted the stay previously imposed by a Maryland district judge. This clears the path for the Department of Government Efficiency (DGE), a body established under the Trump administration, to obtain critical data from the Treasury Department, the Education Department, and the Office of Personnel Management. The move is expected to bolster the DGE’s efforts to identify areas for cost-cutting and restructuring within the sprawling federal bureaucracy.

The appeals court’s ruling came after a contentious debate among its judges. In a separate but equally tight decision, the court voted 8-7 to reject a request for an en banc hearing, which would have seen the case reconsidered by the full panel of active judges. The narrow margin underscores the divisive nature of the case, which pits concerns over data privacy and governmental oversight against the push for greater efficiency in public spending.

The Musk-led initiative has been a lightning rod for controversy since its inception.
